What this covers
Only shared books can be seen by anyone other than their creator. Private projects are readable by their owner alone, so a notice can only concern a book that is unlisted or public. We respond to notices under the Digital Millennium Copyright Act (DMCA) and to equivalent notices from outside the United States.
Sending a notice
Email hello@comiccraft.io with the subject line "Copyright notice". To act on it we need everything the law asks for:
- The work you say has been copied, or a representative list if there are many.
- The address of the book or page on ComicCraft (it starts with /read/) and, if it helps, the page numbers.
- Your name, postal address, telephone number and email address.
- A statement that you believe in good faith that the use is not authorised by the copyright owner, their agent or the law.
- A statement, under penalty of perjury, that the notice is accurate and that you are the copyright owner or authorised to act for them.
- Your physical or electronic signature.
A notice missing any of these is answered with a request for the rest, and the clock starts when it is complete. Sending a notice about work you do not own, or that is clearly fair use, can make you liable for the other side's costs.
What happens next
We take the book out of the showcase and off its shared address, tell the creator what was claimed and by whom, and pass them a copy of the notice. The creator's private project is not touched: the material stays in their account and stops being readable by others.
Counter-notices
If your book was taken down and you believe that was a mistake or a misidentification, email the same address with the subject line "Counter notice", including: the address of the book, a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification, your name, address and telephone number, a statement that you consent to the jurisdiction of the federal court for your district (or, outside the United States, any district in which Kutluozen Works LLC may be found) and that you will accept service from the person who sent the notice, and your signature. We forward the counter-notice to the person who sent the notice. If they do not tell us within ten business days that they have filed a court action, we restore the book.
Repeat infringers
An account that receives more than one valid notice that is not withdrawn or successfully countered is closed. Accounts used to publish the same infringing work again after a takedown are closed on the first repeat.
